These terms form part of the Master Services Agreement. The DPA prevails for Personal Data. They apply to AI-assisted features, not to every automated function in the service.
1. Scope and intended use
AI-assisted features help identify relevant advertising keywords and product targets. Outputs can be inaccurate, incomplete, inappropriate or similar to outputs supplied to other customers. They are not professional advice or a guarantee of advertising results. Do not use the Services for prohibited high-impact decisions about individuals, as described in the Acceptable Use Policy.
Automation may affect live campaigns according to your configuration. Review the available settings, outputs and activity history, and monitor your advertising accounts. Changing a setting cannot undo delivered advertising or spend already incurred. Human approval before every action is not promised by these terms.
2. Input, output and rights
You are responsible for having the rights and lawful authority to provide input and use output. As between you and Advigator, you retain rights in your input and own any rights that Advigator may have in output generated for you; Advigator assigns those rights to you to the extent legally transferable. This does not guarantee that output qualifies for intellectual property protection, is unique or is free of third-party rights. No rights in our software or third-party models are transferred. Input and output are Customer Data under the Agreement.
3. Data used by AI features
Processing may include product titles, categories, product identifiers, search phrases, candidate targets and related instructions. These fields can incidentally contain personal information. Do not include unnecessary personal data, sensitive information or third-party confidential material. Account passwords, platform access tokens and payment details are not intended AI input.
Personal Data remains subject to the DPA. Describing a field as product data does not remove its legal protection when it identifies a person.
4. Providers, locations and restrictions
AI processing uses OpenRouter and third-party inference services. The provider register describes known providers and locations, including processing that may occur in the United States and China. A model developer is not necessarily the entity hosting inference. No EU-only processing, provider restriction or zero-retention configuration is included unless expressly confirmed in writing.
Before purchase, tell legal@advigator.com about any restrictions on AI, vendors or countries. Ask for confirmation of available controls and how to disable an affected feature; do not assume that a requested restriction has been implemented until confirmed.
5. Training, retention and confidentiality
Advigator does not use Customer Data to train generally available machine learning models. The Agreement requires equivalent contractual protection from AI Sub-processors. This commitment is distinct from provider retention for service delivery, abuse prevention or legal obligations; it does not by itself promise zero retention or no human access.
Applicable provider retention, permitted access and transfer safeguards must be confirmed for the service configuration. A provider may not process Customer Personal Data without the safeguards required by the DPA. Information about safeguards can be requested at legal@advigator.com.
6. Third-party terms and changes
Where a third-party licence or acceptable-use rule must apply to your use, we will identify the provider, relevant terms and affected functionality before making it available to you. No unidentified future third-party terms automatically amend a fixed-term Order Form.
Provider changes follow the DPA notice and objection procedure where applicable. Other material changes follow clause 14 of the Agreement. A feature may be restricted where necessary to comply with law or binding provider requirements, subject to the Agreement’s notice and remedy provisions.
7. Governance and contact
The parties remain responsible for legal duties applicable to their respective use and role. These terms do not classify every deployment under the AI Act or certify a customer’s use as compliant. Contact legal@advigator.com for information needed for your assessment.
