This Acceptable Use Policy is part of the Master Services Agreement. It applies to you and to every Authorised User of your account. Capitalised terms have the meaning given in the Agreement.
1. No unlawful or harmful use
You must not use the Services to violate any law or regulation, to infringe anyone’s intellectual property, publicity or privacy rights, to defraud or deceive, or to promote goods or services whose sale is prohibited in the marketplace where they are advertised.
2. Advertising platform rules
You must comply with the rules of every Advertising Platform you connect, including the Amazon Ads policies and the Amazon Ads Acceptable Use Policy. In particular, you must not use the Services to:
- manipulate search results, reviews or rankings, or engage in click fraud or artificial traffic;
- advertise products you are not authorised to sell, or infringe another seller’s brand;
- operate accounts you are not authorised to access, or share Advertising Platform credentials with anyone not permitted by the platform;
- circumvent a suspension, restriction or enforcement action taken by an Advertising Platform.
A breach of an Advertising Platform’s rules through the Services is a breach of this policy.
3. Data restrictions
You must not submit to the Services, or instruct the Services to process:
- special category data under Article 9 GDPR — data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic or biometric data, health data, or data about sex life or sexual orientation;
- sensitive personal information as defined under US state privacy law, including government identifiers, financial account numbers, precise geolocation and account credentials submitted as campaign content. This does not prohibit credentials used through our intended authentication or authorised platform-connection flow;
- sensitive or special data under other applicable laws. This contractual restriction does not imply that every jurisdiction defines a separate sensitive-data category;
- personal data of children, or of anyone under the age at which consent can be given in their jurisdiction;
- personal data for which you do not have a lawful basis to instruct us to process it.
Advigator is built to process commercial advertising data. It is not offered as a service for regulated sensitive datasets. If prohibited data is identified, contact us to arrange secure handling and removal; our applicable security duties still apply.
4. No abuse of the platform
You must not:
- probe, scan or test the vulnerability of the Services except under the Vulnerability Disclosure Policy;
- circumvent authentication, rate limits, quotas or access controls;
- access the Services by automated means, or scrape the dashboard;
- introduce malware, or use the Services to distribute it;
- overload or impair the Services, or interfere with another customer’s use of them;
- use the Services to build, train or benchmark a competing product, or to copy their features, workflows or interface;
- resell or provide access to the Services to a third party, except to manage advertising on behalf of your own clients as permitted by the Agreement;
- misrepresent your identity or your authority to act for an advertising account.
5. Automation, responsibly
The Services change bids, budgets and campaign states on your behalf according to the settings you choose. You must configure targets, budgets and limits that reflect commercial decisions you are authorised to make, and you must review the changes the Services record. You must not use the Services to make decisions that produce legal or similarly significant effects concerning an individual, including decisions about credit, housing, education, employment or healthcare.
6. Artificial intelligence features
When you use the AI-assisted targeting features you must not submit prompts, product content or instructions designed to extract other customers’ data, to generate unlawful or deceptive advertising content, or to circumvent the safety controls of the underlying model providers. What is sent to those providers, and how to switch the feature off, is described in the AI Transparency Notice.
7. Reporting
Report abuse of the Services to legal@advigator.com. Report a security vulnerability under the Vulnerability Disclosure Policy.
8. Enforcement
If we believe this policy has been breached we will, where practicable, contact you first and give you an opportunity to fix the problem. Where a breach presents a material security risk, is causing harm to the Services or to other customers, exposes us or an Advertising Platform to legal liability, or where an Advertising Platform requires it, we may suspend access immediately under clause 11.5 of the Agreement. We limit any suspension to what is necessary and restore access as soon as the cause is resolved. Repeated or serious breaches may lead to termination under clause 11.4 of the Agreement.
