Advigator respects intellectual property rights and expects its customers to do the same. Publishing content that infringes a third party’s rights is a breach of the Acceptable Use Policy.
What Advigator does and does not host
Advigator is a tool that its customers use to manage advertising on third-party platforms. Ad creative, product listings and product images live on the Advertising Platform — principally Amazon — which publishes them. Advigator stores customers’ campaign configuration and, for some ad formats, creative assets uploaded for submission to the platform.
This means:
- To have an advertisement or a product listing removed from Amazon, use Amazon’s own intellectual property reporting procedures. Amazon controls publication; we do not.
- To report material stored by Advigator — for example a creative asset uploaded to our platform — or to report infringement of your rights by the Advigator website itself, use the procedure below.
How to send a notice
Email legal@advigator.com with the subject “IP infringement notice” and include:
- Identification of the work or right you claim is infringed, with proof of ownership or of your authority to act for the owner (registration number, or a link to the original).
- Identification of the material you say is infringing, with enough detail for us to find it — a URL, an account, an asset, a campaign name.
- Your name, address, telephone number and email address.
- A statement that you have a good-faith belief that the use is not authorised by the rights holder, its agent, or the law.
- A statement that the information in the notice is accurate and that you are the rights holder or authorised to act on their behalf.
- Your signature, electronic or physical.
Incomplete notices slow everything down. Knowingly making a material misrepresentation may expose you to liability.
What we do
We review notices promptly. Where a notice is valid and the material is within our control, we remove or disable access to it and notify the customer concerned. Repeat infringement is grounds for suspension or termination under clause 11 of the Master Services Agreement.
Counter-notice
If your material was removed and you believe that was a mistake or a misidentification, write to legal@advigator.com with your identification of the material and its former location, your contact details, a good-faith explanation of why removal was mistaken and any supporting evidence. We will pass the counter-notice to the complainant and may restore the material.
This is a general IP reporting process, not a representation of eligibility for a US DMCA safe harbour. Where a statutory notice-and-counter-notice process applies, its mandatory requirements, forum and deadlines govern instead of inconsistent general contract terms.
